Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the services operated by VoltAI, L.L.C., a Wyoming limited liability company (“VoltAI”, “we”, “us”), including the website at voltai.one, the API at api.voltai.one, and the console at console.voltai.one (collectively, the “Service”).
By creating an account or calling the Service you agree to these Terms. If you're agreeing on behalf of a company, you represent that you have authority to bind it.
1. The Service
VoltAI is a gateway that proxies requests to third-party large language model providers (“Upstream Providers”) including Anthropic, OpenAI, Google, xAI, DeepSeek, Alibaba Cloud, Zhipu, Moonshot, and Volcengine. We provide unified billing in U.S. dollars, OpenAI-compatible and Anthropic-compatible API schemas, per- request metering, and the integrity commitments set out in Section 4.
We are notthe author of any model you access through the Service. Model outputs are generated by the Upstream Provider. Your use of any model is additionally governed by that provider's terms, and you agree to comply with them.
2. Accounts and Eligibility
You must be 18 or older and legally able to enter into these Terms. You are responsible for safeguarding your API keys; any call authenticated with your key is billed to your account. Notify us at support@voltai.one immediately if you suspect compromise.
3. Acceptable Use
You agree not to use the Service to:
- Violate any law or third-party right;
- Generate, distribute, or facilitate CSAM, non-consensual intimate imagery, or content that sexualizes minors;
- Plan or facilitate violence, terrorism, or the creation of weapons capable of mass harm;
- Conduct large-scale disinformation, political manipulation, or identity fraud;
- Circumvent Upstream Provider safety systems, rate limits, or regional restrictions;
- Resell raw model access as if it were your own model (you may build products on top of the Service).
We may suspend or terminate accounts that violate this section. Where time allows, we'll notify you first; where harm is imminent, we won't.
4. The Integrity Commitment (Contractual)
The promises published at /integrity are part of these Terms. Breach of any subsection below is a material breach and triggers the refund remedy in Section 4.5.
4.1 One model name, one official upstream
When you request a model by the name listed on our pricing page, your request is forwarded to the official upstream endpoint published by that model's vendor — and to no other model. Specifically, and without silent substitution:

We will not route a flagship model to a distilled clone, a quantized variant, or a cheaper model under load. If an Upstream Provider is unavailable, your request fails with the upstream error code — we do not silently fall back to a different model.
4.2 No prompt injection, no response rewriting
Your request body is forwarded byte-for-byte to the Upstream Provider except for two documented transformations: (a) authentication (we substitute your VoltAI key with an upstream key) and (b) optional, opt-in protocol translation between OpenAI-compatible and Anthropic-compatible schemas, which you can disable with the HTTP header X-Volt-Passthrough: strict. We do not inject system prompts, rewrite responses, or add safety wrappers.
4.3 Daily benchmark parity
Every 24 hours we run a public evaluation sample against every flagship model we list, through VoltAI and through a direct upstream key, and publish the delta at /integrity. Our target is a delta of 1.5 percentage points or less on MMLU-Pro subset, GSM8K, and HumanEval. If the delta exceeds 1.5 percentage points for two consecutive days on a given model, we pause that model in the console and trigger the refund remedy for affected usage.
4.4 Bring Your Own Key (enterprise)
Enterprise accounts may configure their own Upstream Provider keys. When BYOK is enabled for a model, VoltAI handles authentication, metering, and rate-limiting only; we do not have plaintext access to the model output.
4.5 Refund remedy
If we breach Section 4.1, 4.2, or 4.3, you are entitled to a full refund of the fees paid for the affected model during the failing billing period, without a support ticket, without arbitration, and without a dispute-resolution waiting period. We will also publish an incident report at /integrity/incidents within 72 hours, describing the breach, its scope, and its remediation.
This remedy is in addition to, not in place of, other rights you may have under applicable law.
5. Fees and Billing
Prices are denominated in U.S. dollars and consist of (a) the Upstream Provider's published per-token rate, passed through at cost, and (b) VoltAI's gateway fee, disclosed on /pricing and itemized on every invoice. When an Upstream Provider changes its rate, we mirror that rate within 24 hours of publication and notify account admins.
You pay by pre-funded credit. Unused credit is refundable for 30 days from deposit. Charges are metered per request; each invoice includes per-call token counts, latency, and the exact fee breakdown. We do not charge a subscription and there is no minimum commitment on the self-serve plan.
6. Data and Confidentiality
We handle your requests and responses as described in our Privacy Policy. In summary: we do not train models on your content; we retain request/response bodies only as long as necessary for billing, abuse detection, and the parity benchmark, subject to the retention table in the Privacy Policy; and we never sell your data.
7. Intellectual Property
As between you and us, you own the prompts you submit and (to the extent permitted by the Upstream Provider's terms and applicable law) the outputs generated in response. We own the Service itself, including the website, API surfaces, console, documentation, and brand. Nothing in these Terms grants you a license to VoltAI trademarks.
8. Disclaimers
The Service is provided “as is” and “as available.” Except for the refund remedy in Section 4.5 and any enterprise SLA we separately sign with you, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Model outputs may be inaccurate, biased, or unsafe; you are responsible for reviewing and validating them before relying on them.
9. Limitation of Liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, consequential, special, or punitive damages. Our aggregate liability for any claim arising out of or relating to these Terms is capped at the greater of (a) U.S. $100 or (b) the fees you paid to us in the twelve months before the event giving rise to the claim. This cap does not limit the Section 4.5 refund remedy or liability that cannot be limited by law (including fraud, willful misconduct, and breach of confidentiality).
10. Term and Termination
You may close your account at any time from the console. We may suspend or terminate your access for material breach (including Section 3) with notice where practicable. On termination, unused pre-funded credit is refunded within 10 business days; Sections 4.5, 6, 7, 8, 9, and 11 survive termination.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of Wyoming, U.S.A., without regard to conflict-of-laws principles. For claims under U.S. $10,000 you may bring suit in small-claims court where you reside. Otherwise, disputes will be resolved in the state or federal courts located in Laramie County, Wyoming, and both parties consent to that jurisdiction.
Nothing in this section restricts your statutory consumer-protection rights under the law of the country in which you ordinarily reside.
12. Changes and Contact
We may update these Terms. Material changes will be announced on the site and, where we have it, by email to account admins at least 30 days before they take effect. If you keep using the Service after a change takes effect, you accept the revised Terms.
